[ Law & Legal ] Open Question : Can he do this? Please help me?

OI asked that question a few weeks ago. I contacted connexions and the apprenticeship helpline and they put me through to this legal people who told me to file a claim in the employment tribunal and they appointed me a lawyer and everything but they said I had to write my employer a letter and if he still doesnt pay me then they go ahead and yesterday he emailed me:

“You can seek and take the claim forward as you wish.
But bear in mind you were not employed by us under any circumstances, you
were taken on an informal trial basis to assess your performance.i cannot
see how you can be unfairly dismissed.”

He didnt tell me i was on trial after the 3 weeks! He just never paid me! How can you have a trial for 10 weeks? He told me not to come back to work right after I had told him I spoke to the apprenticeship helping and they said what he was doing illegal. After I told him that he said dont come back on monday.

Can he actually get away with saying I was on trial doing 40 hours a week for 10 weeks??
